1. About Gymelo (The Platform)
Gymelo is an online technology platform that connects:
- Users who wish to buy, sell, or transfer their unused gym memberships.
- Gym Owners / Fitness Centers that list their gym packages, promotions, or use our digital management tools (such as membership tracking and WhatsApp reminders).
Gymelo acts solely as an intermediary/facilitator. Gymelo is not a gym, fitness center, or financial institution.
2. Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts under Indian law to use Gymelo. By using the platform, you represent that you meet this requirement.
3. C2C Membership Transfer & Marketplace Rules
If you list or buy a membership through Gymelo:
- Gym Approval Required: Every gym has its own internal transfer policy. The buyer and seller acknowledge that transferring a membership is ultimately subject to the approval of the respective gym management. Gymelo is not responsible if a gym refuses a transfer.
- Accuracy of Information: Sellers must provide accurate details regarding the remaining validity, package type, and pricing of the membership. Any fraudulent listings will result in an immediate permanent ban.
- Payments & Commission: All payments processed through the platform are subject to standard payment gateway terms. Gymelo may charge a convenience or platform fee for facilitating the transaction.
4. Limitation of Liability (Legal Protection for You)
- Gymelo does not guarantee the quality, safety, or legality of the gyms listed by third parties, nor the truthfulness of user-listed memberships.
- Gymelo shall not be held liable for any direct, indirect, incidental, or consequential damages arising out of disputes between buyers, sellers, or gym owners (including gym closures, disputes over equipment, or personal injuries inside a gym).
5. User Conduct
You agree not to:
- Use the platform for any illegal or unauthorized purpose.
- Post fake, misleading, or deceptive listings.
- Harass, abuse, or harm other users or gym representatives.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal disputes shall be subject to the exclusive jurisdiction of the courts in Panchkula / Chandigarh, Haryana.
