By creating an account or using GYMELO ("the Platform"), you agree to these Terms of Service. If you do not agree, please do not use the Platform.
GYMELO is a marketplace that facilitates the buying and selling of gym memberships between users ("Buyers" and "Sellers"). GYMELO acts as an intermediary and is not a party to the membership transfer between users and gyms.
Sellers must only list memberships they legally own and have the right to transfer. Sellers must verify with their gym that the membership is transferable before listing. Buyers are responsible for verifying membership details before purchase. All users must provide accurate information and not engage in fraudulent activity.
GYMELO charges a 5% platform fee on the membership asking price. This fee is non-refundable except in cases where GYMELO determines the seller acted fraudulently. Gyms may charge separate transfer fees which are the responsibility of the parties involved.
All payments are held in escrow by GYMELO until the gym confirms the membership transfer. If a transfer is not completed within 7 days, the buyer receives a full refund. Sellers receive payment within 2–3 business days after successful transfer confirmation.
Buyers may raise a dispute within 48 hours of transfer confirmation. GYMELO will review disputes and make a final determination within 5 business days. GYMELO's decision on disputes is final.
Users may not list memberships they do not own, create fake accounts, manipulate listings or reviews, attempt to circumvent the escrow system, or use the platform for any illegal purpose.
GYMELO is not liable for the actions of gyms, including their refusal to transfer memberships. GYMELO's liability is limited to the amount of platform fees collected for the relevant transaction.
These terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of courts in India.
